Thank you for choosing Camera Tech Source Studio & Accessories Ltd. Please read these Terms and Conditions carefully before using our website, purchasing products, renting equipment, utilizing our studio space, or accessing our repair services. By engaging in any of these activities, you agree to be bound by the following terms and conditions:

1. Product Sales:
   
   a. Product Descriptions: We strive to provide accurate and detailed product descriptions for all cameras, camera accessories, and related products sold on our website. It is your responsibility to review the product descriptions and specifications before making a purchase.
   
   b. Pricing: All prices displayed on our website are in JMD, USD, CAD and are subject to change without prior notice. We make every effort to ensure accurate pricing. In the event of a pricing error, we reserve the right to cancel or modify orders as necessary.

2. Rental Services:
   
   a. Term of Agreement: The parties do herein bind themselves to the terms of this Agreement regarding all equipment rented by Customer from CAMERA TECHSOURCE STUDIO AND ACCESSORIES LIMITED from the date of this Agreement until terminated, modified or replaced.
   
   b. Non-Exclusivity: This is a nonexclusive Agreement, nothing herein contained shall obligate Customer to rent Camera Techsource Ja. nor Camera Techsource Ja. to rent to customers during the life of this Agreement. However, in the event of rental transactions, this Agreement shall govern until it has been modified, terminated or replaced.
   
   c. Price: Unless otherwise agreed to in writing by an authorized agent of Camera Techsource Ja., the price listed in the Camera Techsource Ja. Equipment Rental Catalog in effect at the time the customer receives rental equipment shall control.
   
   d. Warranty of Authority: Customer hereby warrants that any person which it directs or allows to receive equipment from Camera Techsource Ja. and who shall sign for acceptance of said equipment is authorized by Customer to do so. Customer hereby waives any obligation on the part of Camera Techsource Ja. to confirm said person’s authority to act on behalf of Customer.
   
   e. Maintenance of Equipment: The Customer agrees to keep and maintain all the rental equipment in good condition and assumes full responsibility for all the equipment and supplies until the rented items are returned. The Customer agrees not to remove, cover, alter or deface any tags, serial numbers or nameplates on the equipment.
   
   f. Insurance: The Customer agrees to obtain, at Customer’s own expense, all-risk insurance coverage equal to the replacement value without deduction for depreciation of the rented equipment.
   
   g. Lost and/or Damaged Equipment: In the event of any loss or damage to the rented equipment, the Customer agrees to pay the rental rate during the period of time Camera Techsource Ja. is deprived of the equipment and until such time as it is repaired and/or replaced. The Customer agrees that the value of the rented equipment, in the event of damage and/or loss requiring replacement rather than repair of said equipment, is the replacement value as determined by the manufacturer’s list price at the time of said loss.
   
   h. Inspection of Equipment: The Customer acknowledges that Customer’s agent (as defined in paragraph 4 above) by executing a Rental Checkout Sheet for equipment warrants on behalf of Customer that the equipment has been examined and tested by Customer and that the same is in good working order and condition. In the event equipment is shipped to Customer, Customer’s failure to notify Camera Techsource Ja. of any defects or problems with equipment within 24 hours of receipt shall be conclusively deemed as acknowledgment that all equipment has passed customer approval and is in good working order.
   
   i. Exclusion of Warranties: CUSTOMER HEREIN ACKNOWLEDGES THAT ALL EQUIPMENT TO BE RENTED FROM Camera Techsource Ja. WILL BE AS A RESULT OF CUSTOMER’S SOLE SELECTION, DISCRETION AND OPINION AS TO EQUIPMENT WHICH IT REQUIRES. ALL EQUIPMENT IS ACCEPTED BY CUSTOMER “AS IS”. NO WARRANTIES OR REPRESENTATIONS ARE MADE BY Camera Techsource Ja. OF ANY TYPE OR NATURE WHATSOEVER, EXPRESSED OR IMPLIED, REGARDING THE PERFORMANCE OF CAMERAS, SERVICES, SUPPLIES, FILM OR OTHER EQUIPMENT RENTED. Camera Techsource Ja. HEREIN EXPRESSLY EXCLUDES ANY AND ALL WARRANTIES, GUARANTEES, EXPRESSED OR IMPLIED, STATUTORY, BY OPERATION OF LAW, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT, UNDER NO CIRCUMSTANCES, SHALL Camera Techsource Ja. BE RESPONSIBLE OR LIABLE TO CUSTOMER OR ANYONE ELSE FOR ANY DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS OR OTHER DIRECT OR INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE ANY EQUIPMENT RENTED OR THE ALLEGED BREACH OF ANY AGREEMENT DESCRIBED HEREIN, EVEN IN THE EVENT THAT STRATTON CAMERA OR STRATTON CAMERA’S AGENTS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
   
   j. Indemnification and Hold Harmless: The customer agrees to assume full responsibility and liability for the safekeeping and return of all rented equipment accepted by Customer as shall be set forth in Camera Techsource Ja. Rental Checkout Sheet. Customer agrees to indemnify and hold harmless Camera Techsource Ja. and any other persons to which Camera Techsource Ja. itself may be responsible to indemnify and hold harmless, from all liability, claims, damages, costs and expenses arising from Customer’s use, misuse and/or possession of the rented equipment.
   
   k. Returned Equipment: Acceptance by Camera Techsource Ja. of the return of rented equipment does not waive any claims that the company may have against the Customer for patent, latent or hidden damage to the equipment. Camera Techsource Ja. shall have a reasonable period after the return of said equipment to discover said damages.
   
   l. Inspection/Repossession of Equipment: The Customer agrees to admit any employee or agent of Camera Techsource Ja. to enter the premises upon which equipment is kept for the purposes of checking the condition of the company’s equipment and/or for repossessing the equipment in the event the Customer is in default of any term of this Agreement whatsoever.
   
   m. Exclusive Possession/Non-Assignability of Lease: The Customer shall not sublease or loan the equipment or assign this Agreement to any other persons, firms or corporation and said equipment shall always remain under the immediate, exclusive control and direction of the Customer.
   
   n. Cost of Shipment: When required, Camera Techsource Ja. shall arrange for shipment of rental equipment to Customer and any and all shipment costs incurred by Camera Techsource Ja. shall be a charge included against the Customer’s account.
   
   o. Miscellaneous Provision for Liens, Charges, etc.: The Customer specifically acknowledges Camera Techsource Ja. ownership of the equipment and agrees to keep the equipment free of all liens and encumbrances. The Customer agrees that he shall be liable for all taxes, transportation charges, duties, broker fees and all other costs imposed upon the equipment.
   
   p. Headings: The headings as to the contents of particular paragraphs of this Agreement are inserted for convenience and reference only and shall not be construed as a part of this Agreement nor be considered in construing the terms hereof.
   
   q. Entire Agreement: This Agreement sets forth the entire understanding and agreement between the parties hereto with respect to the subject matter hereof and cancels and supersedes any prior oral or written agreement between the parties with respect to the subject matter. No alterations, additions, amendments or modifications to this Agreement shall be binding unless made in writing and executed by an authorized agent of Camera Techsource Ja.
   
   r. Construction: In the event any parts of this Agreement are found to be void, the remaining provisions of this Agreement shall be binding with the same effect as if the void parts were not included. CUSTOMER DOES HEREIN WARRANT THAT ITS AUTHORIZED AGENT HAS READ THE TERMS OF THIS AGREEMENT, UNDERSTANDS THE SAME AND DOES SIGN IT ON BEHALF OF CUSTOMER. THE BELOW SIGNOR FOR CUSTOMER DOES HEREIN WARRANT THAT HE/SHE IS DULY AUTHORIZED TO BIND CUSTOMER TO EACH AND EVERY TERM OF THIS AGREEMENT

3. Studio Space:
   
   a. Reservation: Our studio space can be reserved for photography, cinematography and event hosting purposes. Reservation requests are subject to availability and confirmation.
   
   b. Usage Guidelines: When utilizing our studio space, you are responsible for adhering to any specific rules, regulations, or safety guidelines communicated to you. This includes proper care of the equipment, cleanliness, and compliance with local laws and regulations.

4. Repairs and Services:
   
   a. Repair Services: Camera TechSource Studio & Accessories Ltd offers repair services for photography equipment. We strive to provide accurate repair estimates and complete the repairs within a reasonable timeframe. However, the exact repair duration and cost may vary depending on the availability of parts and the complexity of the issue.
   
   b. Warranty: We offer a limited warranty on repairs conducted by our technicians. The specific warranty terms, including the duration and covered components, will be provided to you at the time of repair. The warranty is applicable only to the repaired components and does not cover any unrelated issues or subsequent damage caused by mishandling.

5. Return and Refund Policy:
   
   a. Refunds or exchanges are available solely for products that exhibit manufacturer defects and are reported within a 30-day period from the date of purchase. All Refunds will be actioned in the form of bank transfer ONLY.
   
   b. Rental Returns: Rental equipment must be returned in the same condition as received. Any damages and Late returns may incur additional charges as outlined in the rental agreement.

6. Privacy:
   
   a. Data Collection: We respect your privacy and are committed to protecting your personal information. We collect and process data in accordance with our Privacy Policy, which outlines the types of data we collect, how we use it, and your rights regarding your personal information.
   
   b. Data Security: We implement reasonable security measures to protect your personal information from unauthorized access, loss, or misuse. However, no data transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute data security.

7. Limitation of Liability: Camera TechSource Studio & Accessories Ltd is not responsible for any direct or indirect damages, losses, or liabilities arising from the use of our website, purchase of products, rental services, utilization of studio space, or repairs. We are not liable for any damages resulting from the misuse, improper handling, or unauthorized modifications of products purchased from us.

8. Governing Law: These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Jamaica. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Kingston & St Andrew.
